![]() ![]() The final verdict gave abortion advocates a greater victory than they expected and imposed an abortion policy on states that was far more extreme than those of comparable nations. As a result, the Supreme Court decision not only nullified anti-abortion laws in 30 states, but it made abortion a Constitutional right throughout all 50 states. The final decision was not based on a specific text in the Constitution, but on the penumbra surrounding several of the amendments. Baird, 7 out of 9 justices ruled that women had a right to an abortion based on their right to privacy. Using precedent court cases from Griswold v. Wade simply to decide procedural application and jurisdiction on abortion issues between the state and federal courts, during the trial, without any factual medical records, the Supreme Court judges determined they had the jurisdiction to try the constitutional issue of whether women had a right to an abortion. By using historical and qualitative studies, I am researching how the case was accepted in the Supreme Court and how the justices came to their verdict.
